Service Agreement

FantasticQuad provides guided quad biking tours and adventure experiences in Agadir and throughout Morocco. Our services include:

• Guided quad bike tours through diverse Moroccan landscapes
• Professional safety equipment and instruction
• Transportation to and from tour locations
• Cultural experiences and local insights
• Photography services during selected tours

Booking and Reservations

• All bookings require a valid deposit as specified at time of reservation
• Full payment is due 48 hours before tour departure
• Group bookings may have different payment terms
• Confirmation details will be sent via email within 24 hours

Liability and Risk Acknowledgment

Inherent Risks

Adventure tourism activities involve inherent risks that cannot be completely eliminated. By participating, you acknowledge and accept these risks include but are not limited to:

• Mechanical failure of equipment or vehicles
• Weather-related hazards and changing conditions
• Terrain-related risks including uneven surfaces and obstacles
• Risk of collision or loss of control of quad bikes
• Wildlife encounters in natural environments
• Remote location access and emergency response delays

Liability Limitation

To the fullest extent permitted by law, FantasticQuad's liability is limited as follows:

• Our maximum liability shall not exceed the total amount paid for your tour
• We are not liable for indirect, consequential, or punitive damages
• Liability exclusions apply except in cases of gross negligence or willful misconduct
• Participants assume responsibility for their own actions and decisions

Participant Requirements

Age and Experience

• Minimum Age: 16 years for quad bike operation (younger participants may ride as passengers)
• Driving License: Valid driving license required for quad bike operators
• Experience Level: No prior quad biking experience necessary - full instruction provided
• Maximum Age: No upper age limit, but physical fitness assessment may be required

Health and Fitness Requirements

• Participants must be in reasonable physical condition
• Disclosure of any medical conditions that may affect participation
• Pregnancy restrictions apply - consult with our team
• Heart conditions, back problems, or recent surgeries must be declared
• Participants under influence of alcohol or drugs will be refused service

Required Documentation

• Government-issued photo identification
• Valid driving license for quad bike operators
• Signed waiver and release forms
• Emergency contact information
• Travel insurance documentation

Cancellation and Refund Policy

Customer Cancellations

• More than 7 days: Full refund minus 10% processing fee
• 3-7 days before: 50% refund of total amount paid
• Less than 48 hours: No refund unless exceptional circumstances
• No-show: No refund provided

FantasticQuad Cancellations

We reserve the right to cancel tours due to:

• Severe weather conditions or safety concerns
• Insufficient participant numbers (minimum 2 people required)
• Equipment failure or maintenance requirements
• Government restrictions or force majeure events

In case of our cancellation: Full refund or rescheduling at no additional cost.

Rescheduling

• Free rescheduling available up to 48 hours before tour
• Subject to availability and seasonal pricing differences
• Weather-related rescheduling always free of charge

Governing Law and Disputes

Applicable Law

These terms and conditions are governed by the laws of the Kingdom of Morocco. Any disputes arising from our services shall be subject to the jurisdiction of Moroccan courts.

Dispute Resolution

• First Step: Direct communication with our management team
• Mediation: Good faith attempt at mediated resolution
• Arbitration: Binding arbitration under Moroccan commercial law
• Legal Action: Agadir courts have exclusive jurisdiction

Class Action Waiver

Participants agree to resolve disputes individually and waive the right to participate in class action lawsuits or collective proceedings.

Conduct and Safety Rules

Mandatory Safety Compliance

• All safety equipment must be worn at all times during tours
• Follow guide instructions immediately and without question
• Maintain safe distances from other participants and obstacles
• No consumption of alcohol or drugs before or during activities
• Report any equipment issues or safety concerns immediately

Behavioral Expectations

• Respectful behavior toward guides, staff, and other participants
• Environmental responsibility and Leave No Trace principles
• Respect for local customs and cultural sites
• No harassment, discrimination, or inappropriate behavior

Consequences of Non-Compliance

Modifications and Updates

Terms Updates

FantasticQuad reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website.

Service Changes

• Tour itineraries may be modified for safety or operational reasons
• Equipment upgrades or substitutions may occur
• Pricing subject to change with advance notice
• Seasonal schedule adjustments may apply

Communication

• Important updates communicated via email and website
• Participants responsible for checking current terms before each booking
• Continued use of services implies acceptance of updated terms
